Intervention petitions on Meralco PSAs denied by ERC

The Energy Regulatory Commission has denied petitions that want to intervene with the hearings reading Manila Electric Co. (MERALCO)’s power supply agreements (PSAs).

These PSAs include are Meralco’s contracts with RP Energy, St. Raphael Power Generation Corp. (SRPGC), Atimonan One Energy Inc., and the Panay Energy Development Corp.

Four petitions for intervention of the seven PSA applications were denied by the ERC, but will be treated as opposition.

“The commission deliberated and resolved to deny the petitions filed by Romeo Junia, Fe Bait et al., and Uriel Borja to be admitted as intervenors,” ERC said in its order.

The rejected motions were due to lack of personality to file, and failure to submit a motion for intervention within five days prior to the initial hearing.

“However, the said petitions are hereby treated as oppositions,” the ERC added.

“If you are treated as an oppositor, you may submit your position paper anytime during the proceedings for the commission’s consideration,” ERC spokesperson Floresinda Digal said.

As for the three remaining PSAs, ERC has yet to set the hearing, Digal said.

These are PSAs with the Central Luzon Premiere Power Corp. (CLPPC) and Mariveles Power Generation Corp (MPGG), and Global Luzon Energy Development Corp. (GLEDC).

In April 2016, Meralco has signed seven PSAs involving 3, 551 megawatts with different power companies. These corner 81 percent of the combined output of the seven power plants.
