DOE tightens compliance rules on power generators

The Department of Energy (DOE) has issued a circular strengthening accountability rules for power generation entities, tightening compliance, reporting, and enforcement standards across the sector.
Released today, Department Circular No. DC2026-02-0006 requires all entities operating generation facilities for end-users to maintain valid certifications, permits, and clearances, and to ensure continuous compliance with applicable laws and industry standards. Covered entities include generation companies, new power providers, microgrid service providers, the National Power Corporation–Small Power Utilities Group, distribution utilities and local government units with generation operations.
The circular mandates accurate and transparent reporting to regulators, periodic operational and technical assessments, and immediate disclosure of significant incidents affecting power security or reliability. Operators must submit corrective work plans to restore capacity within defined timelines.
Non-compliance may trigger administrative fines, suspension or cancellation of permits, disqualification from DOE-administered competitive selection processes and capacity programs, and other enforcement actions allowed under existing regulations. Violations may be determined through required submissions, DOE assessments, or validated complaints.
“Accountability in the generation sector is essential to safeguarding power supply and sustaining confidence in the industry,” Energy Secretary Sharon S. Garin said. “This Circular reinforces clear standards and transparent reporting, and it supports timely corrective action to keep the power system dependable for households and businesses.”
The issuance comes as regulators heighten focus on plant performance and outage management amid recurring supply tightness during peak demand periods. It also follows recent DOE measures aligning generation investments with grid needs, signaling closer scrutiny of both capacity development and operational discipline.
