ERC moves to shorten approval time for power contracts and projects

The Energy Regulatory Commission (ERC) has moved to fast-track applications in the power sector by adopting summary proceedings that shorten deliberation times for projects and contracts.
In a statement, ERC said that the move supports the government’s target of achieving total electrification nationwide and reflects its commitment to building a “new ERC” that is more responsive and efficient.
Under Resolution No. 16, Series of 2025, promulgated on September 29, the process will apply to uncontested applications such as approvals of capital expenditure (CAPEX) projects, power supply contracts, and dedicated point-to-point transmission facilities. It will also cover applications for confirmation of over- or under-recoveries, issuance of Certificates of Public Convenience and Necessity, and business separation and unbundling plans.
The ERC said the same streamlined process may be applied in cases with intervenors if all parties agree. The resolution is anchored in Rule 17 of the commission’s Revised Rules of Practice and Procedure (RRPP), which already allows summary proceedings.
ERC clarified that the summary procedure dispenses with trial-type hearings and significantly reduces the time allotted for receiving evidence compared to the regular procedure.
Parties may be asked to submit affidavits and supporting documents within set deadlines, after which the Commission can resolve the matter based on the filings.
ERC Chairperson and CEO Atty. Francis Saturnino C. Juan said the move reflects the commission’s push to eliminate unnecessary delays. “We will do everything we can to accelerate the resolution of applications filed before the ERC. Streamlining our processes is key to fulfilling our commitment to a more responsive and revitalized ERC,” he said.
The commission added that the full text of Resolution No. 16, Series of 2025, is publicly accessible through the ERC website for stakeholder reference.
